Terms of sales


These Terms of Sales set out the terms and conditions that will apply when you purchase products through our website. If something is not clear and you need further clarification or information about these Terms of Sales, please, do contact us at info@ethaca.com. You will be required to confirm that you have read and accept these Terms of Sales before you submit an order to us.

1. General provisions

These general sale terms (hereinafter, ‘‘Terms of Sales’’) apply to all sales of Ethaca products (hereinafter, ‘‘Products’’ or ‘‘Product’’) carried out through the www.ethaca.com home website (hereinafter, ‘‘Website’’).

i. Selling of Products-regulated under these Terms of Sales is only available to cunsumers over the age of eighteen (18), or the age of majority of the individual’s relevant country (hereinafter, ‘‘Customers’’ or ‘‘Customer’’) being natural persons that obtain Products for personal, family or household purposes. Customer is prohibited from purchasing any Product from the Website for purposes of resale and Ethaca expressly disclaims any warranty or claim for damages, consequential or otherwise, resulting from Customer’s intent or attempt to resell any Product purchased from the Website.

ii. The language of any contract of sale through this Website is English.

iii. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays for which Ethaca will not be held responsible.

2. Execution of the Contract

In order to contract with Ethaca you must be over 18 years of age and possess a valid credit or debit card issued by a bank acceptable to us. Children under the age of 18 are not permitted to make purchases from our online store. If you are under the age of 18 and would like to make a purchase, you will need to ask your parent/guardian to make that purchase on your behalf. Ethaca retains the right to refuse any request made by you and also Ethaca reserves the right to close your Ethaca account at its sole discretion. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved and we have debited your credit or debit card.

An order proposal may be refused by Ethaca prior to acceptance and confirmation of the order by Ethaca at its sole discretion, including but not limited to the following circumstances:

(i) the Products are not available; or
(ii) reported, or suspected, fraudulent or illegal activities, including suspected purchases for resale or commercial purposes; or

In case of unavailability of one or more of the ordered Products, the Customer will receive an e-mail informing him/her about the unavailability of the Products. In this case, the order proposal will be cancelled.

The Order Confirmation will include a summary of the essential characteristics of the purchased Product(s), a detailed indication of the price and means of payment, information on delivery charges, information on the conditions and methods to exercise the right of withdrawal, including information on the return policy, the address to which complaints may be addressed, information on support services and on existing commercial terms.

Title to Products and risk of loss or damage during shipment pass from Ethaca to the Customer upon delivery to the destination specified by the Customer.

3. Product image, description and availability

The photographs and images of Products included on the Website and Services (as defined in the Website Terms and Conditions) have been portrayed as accurately as possible. However, the settings and specifications of the Customer’s viewing device or display could affect the accuracy of the colours of Products portrayed.

Information on products and relevant prices are available on the Website. Ethaca reserves the right to make adjustments to the pricing and/or description or features of Products for reasons including, but not limited to, changing market conditions, product discontinuation, material unavailability, changes to manufacturing processes, and errors in advertisements. The style, models and colours of the Products described on the Website may change without notice. Ethaca reserves the right at any time to limit quantities and/or type of Products available from the Website. During the purchasing process, an automatic response will inform the Customer if the order cannot be processed due to the unavailability of the ordered Product.

4. Pricing

Ethaca regularly verifies that prices of the Products displayed on the Website are correct. However, Ethaca cannot guarantee the absence of errors. In the event a Product is listed at an incorrect price, Ethaca reserves the right, prior to delivery, to refuse or cancel orders placed for the Product listed at the incorrect price, regardless of whether the order has been confirmed or payment has been made. In such circumstances, Ethaca will offer the Customer the opportunity to purchase the Product at the correct price. If the Customer’s credit card or PayPal account has already been charged for the purchase and the order is cancelled prior to delivery, Ethaca will issue a credit to the Customer’s credit card or Paypal account. The prices displayed on the Website are quoted in pounds. Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition. Such additional charges are clearly where applicable and are included in the ‘Total Cost’.

5. Payment

Ethaca accepts payments made with: Visa; MasterCard; American Express.

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

More specifically, the transactions will be charged to the Customer’s credit card only after:

(i) the credit card data has been verified;

(ii) the authorisation to charge the card has been received from the issuer of the card used by the Customer;

(iii) the availability of the Product has been confirmed by Ethaca; and

(iv) the order is ready to be shipped.

No charge will be made at the moment of transmission of the order proposal, with the exception of the temporary charge of £1.00 necessary to confirm the credit card’s validity, if any. It is understood that once the order is accepted and confirmed by Ethaca, the temporary charge will be cancelled and replaced by the amount due by the Customer. In the event that the order is cancelled by Ethaca for any reason, this temporary charge will be cancelled as well. In the event that, for any reason, it is impossible to charge the amount due by the Customer prior to acceptance and confirmation of the order by Ethaca, the contract will not be executed and the order will be cancelled.

6. Transport and delivery

Products will be delivered to the address specified by the Customer in the order proposal. In some circumstances and in its absolute discretion, Ethaca may require the signature of the Customer (or of a nominated adult representative) at the time of delivery. Ethaca cannot be held responsible for unanticipated delivery delays beyond Ethaca’s control.

For each order, Ethaca shall invoice the Products by email or by mail to the Customer, pursuant to any applicable laws and regulations. The invoice will be based upon the information provided by the Customer at the time of the order. No alterations to the invoice are possible after the invoice has been issued.

All orders are processed Monday through Friday, excluding Saturday, Sunday and holidays. To estimate the total delivery time for a purchase, please allow up to 2 business days from the order date to process the order for shipment, in addition to the time indicated by the Customer’s preferred shipping method. Unless otherwise specified by Ethaca, for some products, delivery charges will be borne by the Customer and are indicated separately on the order form and invoice. The purchased Product(s) will be delivered by a carrier selected by Ethaca (hereinafter, “Carrier”).

Unless otherwise specified in the Order Confirmation, the purchased Product(s) will be delivered within 30 days from the date of the Order Confirmation (except in the event that an unforeseeable circumstance occurs). In case the delivery has not occurred within the above indicated term, the Customer (by sending an email to the email address info@ethaca.com) will provide Ethaca with a further 10 days to deliver the Product, provided that, in case of failure to comply with such term after receipt of the specified notice, the Customer’s remedies will be limited exclusively to termination of the contract and refund of payment received.

Any damages to the packaging and/or the Product, or discrepancies in the number of items or documentation must be immediately indicated in writing on the Carrier’s delivery receipt. Except to the extent permitted under applicable laws, once the Carrier’s delivery receipt has been signed and no objection has been raised by the Customer, the Customer may not make any objection to the exterior characteristics of the delivered parcel.

7. Shipping and delivery confirmation

Ethaca will send to the Customer a Shipping Confirmation via email once the Products are dispatched.

8. Wrapping and packaging

Products purchased from the Website are delivered with Ethaca’s ”5 senses”® packaging.

9. Returns

Full-price and sale Products must be returned within 14 days from the date of delivery to Ethaca. Ethaca will accept Products in their original condition for a refund of the purchase price when accompanied by the original invoice. Any Product that has been worn, used, altered or damaged will not be accepted. Certain Products, such as ready-to-wear, are shipped with a return tag attached. Returns on these specific Products will only be accepted if the label remains intact. Ethaca reserves the right to refuse return of any Product that does not meet the above return requirements in Ethaca’s sole discretion.

Merchandise returned to Ethaca will be processed within 7-10 business days of receipt. A confirmation email will be sent once the Customer’s account has been credited. Refunds may only be issued in the same form as was utilised for payment. The original shipping charges incurred at the time of purchase are non-refundable.

When you return or exchange any product, you must cover the shipping charges. Easy-to-follow return instructions are included with each shipment. Every effort will be made to ensure a prompt refund and an email notification will be sent once the return has been processed.

10. Exchanges

Ethaca.com cannot accommodate automatic exchanges at this time. The Customer must return the original Product that the Customer wishes to exchange for a refund. A new order can then be placed on the Website for the exchange item. Please, note that new orders are subject to merchandise availability. Ethaca will inform the Customer if Ethaca is unable to fulfil the new order.

11. Lack of conformity

If a Product sold by Ethaca has manufacturing defects or in any case of alleged lack of conformity of Products sold by Ethaca, the Customer must immediately contact info@ethaca.com

In the event that the Customer seeks to have the Product repaired or replaced due to lack of conformity, delivery costs for returning the Product to be repaired or replaced shall be borne by Ethaca, as well as any costs related to the delivery to the Customer of the repaired or replaced Product.

12. Intellectual property rights

The “Ethaca” trademark, together with the set of figurative and non-figurative trademarks, service marks, present in the Products, the relevant accessories and/or packaging, marks consisting of shapes of goods that are subject to registration or otherwise, together with all the illustrations, images and places protected by copyright and more generally all the intellectual property rights relating to the Products, are and remain the exclusive property of the company of Ethaca Ltd.
